A jury Tuesday night acquitted Kevin M. Garner, a 25-year-old Virginia Beach man, of charges related to the shooting death and robbery of a Chesapeake man.
Rahiem Bailey, 29, was killed Feb. 26, 2012, in a house at 2211 Keller Ave. in the Ballentine Place neighborhood.
Garner was charged along with a second man, Andreyus McGee, 22.
McGee pleaded guilty in September 2012 to conspiracy to distribute marijuana and accessory after the fact to murder. He will be sentenced April 4.
Garner’s lawyer, Eric Korslund, said his client called 911 to report that someone had stolen his gun the day Bailey was killed. He said his client had no felony record and had a concealed gun permit.
The gun was recovered in Virginia Beach four days later during a routine traffic stop and later ballistically connected to a shell casing left at the Keller Avenue shooting scene, Korslund said.
